How to Order / Terms and Conditions

PRICING AND DELIVERY

The amounts payable for any goods ordered by you are indicated on my website. Postal and courier charges to be levied will be notified to you in advance of them being incurred. For added security all card payments made on line will be processed by Paypal, as will refunds.
Paypal is a secure and fast on line payment system designed with ease of use and security in mind.

YOUR PAYMENT OPTIONS

You may pay via a Paypal account.

All you have to do is click the BUY NOW button next to the item you wish to buy.

You will be taken to a secure payments page, which is powered by Paypal where you will be asked to enter your payment details.

You will receive an e- mail from me to confirm your order before payment is fully processed. Your order will then be shipped.

YOU ALSO HAVE THE OPTION OF PAYING BY CHEQUE . You may e mail to notify me and place your order, quoting the code number. Send a cheque with your cheque guarantee card details on the back and the goods will be sent once the funds have cleared.

Cheques should be made payable to TERRY LOGAN and sent to LOGAN STUDIO, PARK GRANGE, THRESHFIELD, SKIPTON, NORTH YORKSHIRE, BD23 5HA

Cheques are to be drawn from a UK bank and made out in GB pounds sterling.

DELIVERY POLICY

Please allow up to 14 days for delivery unless otherwise requested.
Your order will be sent via P.O. Parcel Delivery for unframed paintings and prints and by courier in the case of framed paintings  (please note framed paintings under glass cannot be insured against glass breakage, but we will endeavour to minimize this by careful packing).
Overseas orders will be sent in the same way and a delivery date will be confirmed to you via email.

RETURNS POLICY

In the event that you need to return a defective item, please email me at terry@terrylogan.com to let me know and we will refund or replace the item, providing it is a genuine faulty item. In order to qualify for a refund, please return your item in accordance with the following procedure:

  1. Contact me within seven days of your receipt of the item via email stating the reason for the return
  2. All items must be returned unused, undamaged and unaltered in their original packaging accompanied by details of your name, address and receipt number within 14 days of receipt.
  3. Send packages back to me the same way they were dispatched to you.
  4. I will not accept proof of posting as proof of delivery and accept no responsibility for damage to goods caused by the delivery service.
  5. I will contact you to let you know when we have received the item and again when I have processed
    your refund. Please allow up to 30 days for this to take place.
  6. Refunds will only be made to the same debit/credit card items were purchased with.
  7. If the package reaches us outside these time frames I reserve the right not to issue a refund, and/or issue a credit note instead.
  8. I cannot refund any postage/ delivery charges incurred by you. Please be aware that I cannot process any returns that do not follow this procedure.

Gift purchases will be issued with a non-refundable credit note that may be used on the site to purchase another item(s) of the credit note value or of a higher value.

All returns are the responsibility of the customer, to ensure the goods arrive back to me in perfect condition.

GENERAL

I may cancel the contract between us if I have insufficient stock to meet the demands of your order, I do not deliver to your area, the item(s) purchased by you were priced incorrectly for whatever reason.

If I do cancel your contract I will notify you by e-mail and will re-credit to your account any sum deducted by me from your credit card as soon as possible but in any event within 30 days of your order. I will not be obliged to offer any additional compensation for disappointment suffered.

If the goods I deliver are not what you ordered, are damaged or defective or the delivery is of an incorrect quantity, I will not be liable to you unless you contact me within 7 days of your receipt of the items to let me know.

Save as precluded by law, I will not be liable to you for any indirect or consequential loss, damage or expenses howsoever arising out of any problem you notify me of under this condition and I shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit my liability to you for any death or personal injury resulting from my negligence.

I cannot be held responsible for any delays once the goods have left me and are in possession of Royal Mail or other postal or courier service.
I reserve the right to change these terms and conditions from time to time with or without notice. Your continued use of this site will be taken as acceptance to changes posted though I will try to notify you of any changes where possible.

If any part of these terms and conditions is unenforceable the remainder of these terms and conditions will still be enforceable.

Every transaction carried out through this site shall be governed by and interpreted in accordance with English Law. The English Courts shall have exclusive jurisdiction in relation thereto.

These terms and conditions, together with my current website prices outline the whole agreement between you and me relating to the supply of the goods to you by me.

I make no representations or warranties about the accuracy completeness or suitability for any purpose ofthe information and related graphics published on our website. From time to time my site may contain technical inaccuracies or typographical errors, we will try to rectify these as soon as possibly but inevitably some may remain.

All Intellectual Property (IP) sited herein are the property of Terry Logan. I give no permission to use such IP. Product photographs are the property of Terry Logan and no permission is given for them to be used elsewhere.

I will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
